All tire sales, installations, and related services are provided by independent Partner Shops. TireSync does not own, warehouse, handle, or control any tires or automotive products. TireSync facilitates the connection between customers and Partner Shops but is not responsible for the conduct, quality, or performance of Partner Shops or the products and services they provide.

TireSync makes no warranties or representations regarding the safety of any tires or automotive services listed on the Platform. All tires should meet the specifications and standards established by the tire manufacturer and applicable regulatory authorities.

YOU ACKNOWLEDGE THE SAFETY RISKS ASSOCIATED WITH TIRES AND DRIVING. Tire safety depends on many factors, including:

• Proper tire selection for your vehicle, climate, and driving conditions.
• Correct installation by a qualified technician.
• Proper inflation pressure and maintenance.
• Adequate tread depth and condition.
• Vehicle alignment and balance.

TireSync does not guarantee that any tire recommended through the Platform is safe, suitable, or appropriate for your vehicle or driving conditions. You are solely responsible for:

• Verifying that recommended tires are compatible with your vehicle and driving needs.
• Inspecting tires upon delivery or installation for damage or defects.
• Ensuring proper installation by a qualified technician.
• Maintaining tires in accordance with the manufacturer's recommendations.
• Complying with all traffic laws and safe driving practices.

If you have concerns about tire safety or quality, consult the tire manufacturer, Transport Canada, or a qualified automotive professional.

3.1 AI Technology Provider

TireSync uses artificial intelligence (AI) technology provided by Google Gemini to power certain features, including tire recommendations, Q&A responses, and personalized search results.

3.2 AI-Generated Content Limitations

AI-generated content is provided "as is" for informational purposes only and may contain errors, inaccuracies, outdated information, or harmful recommendations. Specifically, AI-generated content may:

• Contain factual errors or misrepresentations about tire products, specifications, or compatibility.
• Recommend tire products unsuitable for your vehicle or driving conditions.
• Provide outdated information about tire technology or specifications.
• Fail to account for important factors relevant to tire selection (climate, driving style, budget, vehicle type).
• Generate biased recommendations that favor certain brands or products.

TireSync makes no warranty that AI-generated recommendations are accurate, suitable, or safe.

3.3 Not Professional Advice

AI-generated tire recommendations do not constitute professional automotive advice. Do not rely solely on AI recommendations for tire selection, installation, or safety decisions. Consult a qualified automotive professional if you have questions about tire compatibility, safety, or performance.

3.4 Responsible AI Use

TireSync is committed to responsible AI use and transparency. However, the nature of AI technology means that outputs are not always predictable, and errors or biases may occur despite our efforts to prevent them.

4.1 Pricing Information

Tire prices and availability displayed on the Platform are provided by Partner Shops and their suppliers. While we strive to maintain accurate and current pricing information, we do not guarantee the accuracy or completeness of pricing data. Prices may change without notice due to:

• Changes in supplier pricing or wholesale costs.
• Currency fluctuations (for imported tires).
• Promotional pricing or temporary discounts offered by Partner Shops.
• Tax calculation errors or regional tax variations.

4.2 Inventory Availability

Tire inventory and availability information is provided by Partner Shops and their supplier networks. TireSync does not control or verify inventory levels. Tires listed as available may become unavailable due to:

• Purchase by other customers.
• Supplier inventory changes or delays.
• Technical errors or data synchronization issues.
• Partner Shop management decisions.

If a tire you have booked or selected becomes unavailable, the Partner Shop will contact you to discuss alternatives.

4.3 Booking Confirmation

A booking confirmation does not guarantee the availability of the selected tire or the ability of the Partner Shop to fulfill the booking at the quoted price. The actual service agreement is between you and the Partner Shop. The Partner Shop reserves the right to cancel a booking if the tire becomes unavailable or if other circumstances prevent fulfillment.

5.1 User-Generated Content

Reviews and ratings on the Platform are provided by users and are not verified, endorsed, or controlled by TireSync. While we have policies against fake or misleading reviews, we do not guarantee that all reviews are authentic or accurate.

5.2 Limitations of Reviews

You should understand that:

• Reviews are subjective opinions based on individual experiences and may not be generalizable.
• Reviews may contain factual errors or exaggerations.
• Some reviews may be from users with biases or competing interests.
• Low-quality reviews or spam may not be immediately detected and removed.

5.3 Your Responsibility

THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TIRESYNC DISCLAIMS ALL WARRANTIES, INCLUDING:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND TITLE.
• WARRANTIES THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS.
• WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
• WARRANTIES THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED.
• WARRANTIES REGARDING THE QUALITY, ACCURACY, OR COMPLETENESS OF ANY INFORMATION OR CONTENT.

Partner Shops are independent contractors and are solely responsible for:

• The quality, safety, and fitness of tires and services they provide.
• Compliance with all applicable laws and regulations.
• Workplace safety and proper employee conduct.
• Insurance and liability coverage.
• Performance of installation services.

TireSync is not responsible for any injuries, damages, or losses arising from Partner Shop conduct, including defective products, unsafe practices, or violation of laws.

9.1 Total Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIRESYNC'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS, DAMAGES, AND LOSSES ARISING OUT OF OR RELATING TO THE PLATFORM, THIS DISCLAIMER, OR THE TERMS OF SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO TIRESYNC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

9.2 Excluded Damages

IN NO EVENT SHALL TIRESYNC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF TIRESYNC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies to all claims arising out of or relating to the Platform, including but not limited to:

• Defective or unsafe products or services provided by Partner Shops.
• Injuries or damages resulting from tire installation or use.
• Platform malfunctions, downtime, or service interruptions.
• Loss of data or account information.
• Unauthorized access to your account.

9.3 Provincial Limitations

SOME PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF YOU ARE A RESIDENT OF SUCH A PROVINCE, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

TireSync is not responsible for your compliance with federal, provincial, municipal, or international laws and regulations regarding tires, vehicles, and driving. It is your sole responsibility to ensure:

• Your vehicle and tires comply with all applicable safety standards and regulations.
• You maintain valid vehicle registration and insurance.
• You comply with speed limits, traffic laws, and safe driving practices.
• Your vehicle passes any required safety inspections or emissions tests.

Failure to comply with applicable laws is not TireSync's responsibility.

The Platform may contain links to third-party websites, services, or resources. TireSync does not endorse, control, or assume responsibility for any third-party websites or services, their content, accuracy, or privacy practices. Your access to and use of third-party websites is governed by their own terms and policies. We encourage you to review their privacy policies before providing any personal information.

TireSync reserves the right to modify, suspend, or discontinue any features or services on the Platform at any time without notice or liability. TireSync is not responsible for any consequences arising from modifications or discontinuation of services.

This Disclaimer is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to any arbitration clause in the Terms of Service, any legal proceedings shall be brought exclusively in the courts of competent jurisdiction located in Toronto, Ontario, Canada.
